How to verify planning permissions, title deeds (Tapu) registration status, and zoning maps before executing payments.

Before executing any payment for property in Cyprus, buyers must perform structured due diligence. Relying solely on developer representations exposes capital to significant risk, including pre-existing mortgages and lack of building permits.

1. Title Deed (Tapu) Verification via Land Registry

The primary check is confirming the seller's sole, unencumbered ownership. A search under Cap. 224 Section 22 is required to check the registry files for active mortgages (memo), tax charges, or third-party claims. Neglecting this step means you could inherit the seller's debts.

2. Verifying Planning Permits and Zoning Maps

Under Cap. 96, developments must have active planning and building permits. We cross-reference cadastral maps with zoning regulations to ensure the property has legal road access and falls within development zones, avoiding demolition risks.

3. Specific Performance Registration under Law 81(I)/2011

Once the Contract of Sale is signed, it must be registered with the Land Registry within 30 days under Law 81(I)/2011. This Specific Performance registration blocks the seller from mortgaging or selling the property to another buyer.
