The Immovable Property Commission (IPC/TMK) was established to provide an effective local remedy for claims relating to immovable property in northern Cyprus. Engaging with this mechanism requires high precision in title verification and valuation methodology, conforming to ECtHR guidelines.

1. Application Requirements and Evidentiary Burden

Applicants must prove ownership prior to 1974 by producing certified title deeds, inheritance certificates, and cadastral maps. Any gaps in the chain of title can lead to the dismissal of the application by the commission. Our team conducts forensic archival research, cross-referencing maps and historic Land Registry entries to construct complete legal title chains that withstand scrutiny by the state attorneys.

2. Remedies Available: Restitution, Compensation, and Exchange

The commission can award several forms of relief under Law 67/2005: restitution of the property (either immediate or after a specified period), financial compensation for loss of use and current value, or exchange of the property for equivalent land. We conduct financial modeling based on historical indexation rates and leasehold valuations to advise clients on which remedy maximizes asset recovery.

3. Appeal Routing to the Supreme Court

Decisions of the commission can be appealed before the High Administrative Court within strict deadlines. If local administrative remedies are exhausted, the record provides the necessary evidentiary basis for subsequent international human rights filings.
